Acceptable Use Policy (AUP)

Users of Imbali Studio cc services are required to agree and adhere to all Terms & Conditions as specified in the AUP, as well as all other company Terms & Conditions & Legal Policies, without exception.

Lawful User Practice
Imbali Studio services, servers, systems and all other available infrastructures may only be used for lawful purposes and lawful activities.

The client may not violate any applicable law or regulations of South Africa or country of residence, and may not use or involve Imbali Studio's infrastructure in any such activity. These activities include, without limitations, activities of fraud, theft, security breaching such as hacking and cracking, malicious behaviour, harassment, use and distribution of pirated software or any other activity violating applicable laws. The client must also comply and adhere to the AUP of any system or networks accessed via the Imbali Studio infrastructure.

The client may not use material or content in any form violating applicable law or regulations in South Africa or country of residence. This material includes, without limitations, material protected by copyrights, patent law, trademark, or any other intellectual property in any form where authorisation of use is required as well as material of pornographic, violent, defamatory or offending nature, or in violation of the law.

Abuse or Misuse of Imbali Studio Services or Resources
SPAM
Spam is strictly prohibited and will result in immediate account suspension.
Spam refers to the sending of unsolicited communications of any kind such as advertising, political or religious material, via Imbali Studio servers or infrastructure, and includes, without limitations:

- Unsolicited bulk messages - junk mail, chain letters
- Creating false accounts with the purpose of sending Spam
- Sending unauthorised emails via 3rd party servers
- Sending emails to clients who requested to be removed from the mailing list
- Distribution of mailing lists to a 3rd party without the consent of the client

The client may not abuse or misuse any Imbali Studio service or resource in any way or form where the action affects the stability or reliability of the service or resource, or degrades the service or resource, or where the action negatively impacts other users, clients or Imbali Studio's services, servers, systems or any other infrastructures.

This includes, without limitations, excessive bandwidth usage, excessive disk usage, inefficient scripts or database queries, operating of services which enables or assists abusive actions by 3rd parties for example through link exchanges or banner exchanges, or any item, service or action which Imbali Studio, at our sole discretion, deem abusive or a misuse of the service or resource.

This abuse or misuse will result in account suspension.

Account Payment
The client agrees to all Billing Terms & Conditions, and to comply with all without exception - The client will pay the account on time as specified, by means of the required or allowed payment method, and/or as per the payment arrangement, and/or signed payment authorisation form.

Failure to comply will result in account suspension, and the client will furthermore remain liable for all cost as per the account plus further cost incurred due to the account suspension such as penalty fees and legal fees.
